In this issue of AlixPartners’ Inside IP, we focus on recent cases involving the Courts’ application of the entire market value rule. As a result of Uniloc v. Microsoft and other cases, the Courts have provided additional guidance for interpreting and applying the entire market value rule to determine an appropriate royalty base and rate.   We highlight several recent cases to illustrate the importance of appropriate apportionment and requirement to provide adequate bases for conclusions.
