Healthcare System Bankruptcy Litigation

AlixPartners’ professionals were retained as experts to analyze damages in connection with the bankruptcy of a major healthcare system. We also analyzed the economics of both the local and national healthcare market over an extended period of time and determined how the market impacted physician acquisition prices, the pricing associated with the sale and disposal of various hospitals and a medical school, and the impact on the rates negotiated in various risk contracts. Our work included the issuance of two expert reports and the provision of expert testimony.

Hospital-Related Antitrust Litigation

We were engaged to conduct a valuation of a hospital in Florida that was the subject of a proposed acquisition. It was alleged that the proposed acquisition may increase the likelihood of collusion or interdependent coordination among the remaining hospitals and health systems in the Orlando market. Our valuation of the hospital was part of the financial analysis surrounding the anti-competitive allegations. Expert testimony was provided at trial.

Acquisition Litigation

A team of AlixPartners professionals was engaged as experts in a significant litigation to perform financial, operational and valuation analysis in connection with the State of California’s attempt to block the merger of two hospitals. Our team assessed whether one of the hospitals involved in the proposed merger was a failing company as that term is used under federal antitrust laws and examined the financial condition and viability of the stand-alone hospital. Our work included the analysis of financial efficiencies that would stem from the merger. Expert testimony was provided at trial. The court’s findings were consistent with our expert opinions and conclusions.
