Ben Forbes, Felix Hammeke and Mat Hughes have co-authored a chapter in International Comparative Legal Guides Merger Control 2021 on The Trend Towards Increasing Intervention in UK Merger Control and Cases that Buck the Trend. The chapter focuses on the growing proportion of qualifying mergers where the CMA finds a realistic prospect of a substantial lessening of competition (“SLC”) at Phase 1 and an SLC at Phase 2. They also discuss two mergers, on which they acted, that were cleared unconditionally at Phase 1 despite customer complaints.
