There is a significant body of case law across Europe relating to agreements between insurance companies and brokers, which addresses how various cooperative agreements may have an anti-competitive object or effect under Article 101. This article considers the characteristics of insurance that affect the analysis of competition in the insurance sector, including the analysis of competitive effects, and the UK Competition Commission’s and Financial Conduct Authority’s investigations into insurance add-ons in private motor insurance and insurance price comparison websites.
